Terms of Service

Draft notice. This document is a starting template. Before going live, the operator must have it reviewed by a Portuguese lawyer specialised in digital and consumer law.
1. Who we are
2chat (“2chat”, “we”, “us”) is a video- and text-chat service operated by an Empresário em Nome Individual established in Portugal. Full operator information is available in our Legal Notice.
2. Acceptance of these Terms
By creating an account or using 2chat you accept these Terms of Service (the “Terms”), our Privacy Policy, our Community Guidelines and any other policy linked from this page. If you do not agree, do not use 2chat.
Acceptance includes consent to moderation. 2chat is a real-time video service used to talk with strangers, and it cannot operate safely without an active moderation layer. By using 2chat you accept that your participation is subject to the moderation tools described in Section 7 below — including the report-triggered safety captures explained there. Moderation is not an opt-in / opt-out preference; it is a condition of use, the same way it is on every comparable random-video platform.
3. Eligibility & minors
You must be at least 14 years old to use 2chat. If you are under 18 you additionally confirm that:
- a parent or legal guardian has reviewed these Terms and the Privacy Policy and consents to your use of 2chat;
- you have provided a valid contact email address for that parent or guardian during sign-up; and
- you understand that 2chat may contact your parent or guardian to verify that consent.
We reserve the right to suspend any account where we cannot reasonably verify the age of the user or, for users under 18, the existence of valid parental consent.
4. Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that takes place through your account. You must notify us immediately at privacy@2chat.tv if you suspect unauthorised access.
5. Acceptable use
Your behaviour on 2chat is governed by our Community Guidelines, which form part of these Terms. In short, you may not:
- harass, threaten, defame or stalk any other user;
- share content that is sexually explicit, depicts minors in a sexual context, glorifies violence, promotes self-harm, or is otherwise illegal in your jurisdiction or in Portugal;
- impersonate any person or entity, or misrepresent your affiliation with a person or entity;
- attempt to bypass moderation, scrape data, reverse-engineer the service or interfere with its security;
- use 2chat to commit or facilitate any criminal offence.
6. User content & licence
You retain all rights in the content you transmit through 2chat (chat messages, video, audio). Because the service requires us to relay that content to other participants and, where necessary, to moderation systems, you grant us a worldwide, non-exclusive, royalty-free licence to host, transmit and process your content for the sole purpose of operating and moderating the service. This licence ends when you delete your account, except for content that we are required to retain by law (e.g. tax records of purchases).
7. Moderation, safety captures & staff messages
2chat is a real-time platform where users video-chat with strangers. To keep the community safe we operate the following moderation tools. By accepting these Terms you accept that all of them may be applied to your account:
- User reporting.Any user can flag another user’s behaviour. Reports are reviewed by our human moderators and may result in a warning, a temporary suspension or a permanent ban.
- Report-triggered safety captures. When you have been reported (or where it is otherwise reasonably necessary to investigate ongoing harm in a room), our moderators can request a single still frame of your local video feed. This capture is targeted, not background surveillance: there is no continuous recording, no random sampling, and no audio. The still is encrypted at rest, only accessible to staff acting on a complaint, kept for at most one hour, and then automatically deleted. It is used exclusively to verify the complaint against these Terms and our Community Guidelines; it is never shared with third parties, never sold, and never used to train AI systems. We rely on Article 6(1)(f) GDPR (legitimate interest in user safety and abuse prevention) and on your acceptance of these Terms as the lawful basis for this processing — there is no per-user opt-out, because an opt-out would defeat the safety purpose for which the mechanism exists. Should you wish to exercise specific GDPR rights (Articles 15, 17, 21) you may do so by contacting privacy@2chat.tv; we may decline an Article 21 objection where compelling legitimate grounds (e.g. an open investigation into harm to another user) override your interest, in line with Article 21(1) GDPR.
- Transparent staff messages. A staff role can send a notice to every participant in a room. Such notices are surfaced as a clearly-labelled system message in chat so the entire room can see them — no covert moderation.
8. Purchases & refunds
2chat offers two paid surfaces: Coins (a virtual in-app currency, see Section 8a) and a recurring Premiumsubscription. All payments are processed by Stripe Payments Europe, Limited; when you check out you also accept Stripe’s terms. Refund rights and the 14-day statutory withdrawal right are described in our Refund Policy.
8a. Virtual currency (“Coins”)
Coins are an internal, non-redeemable virtual currency. They have no cash value, are not legal tender, and cannot be exchanged for money, goods, or services outside 2chat. They are a license to access digital cosmetics and in-app features.
- You can earn Coins for free by signing up, claiming the daily reward, unlocking achievements, or referring friends.
- You can buy Coins with money via the Coins tab. The 14-day right of withdrawal does not apply once Coins are credited to your account, because they are digital content delivered immediately and you waive that right at checkout (Article 16(m) of Directive 2011/83/EU).
- Coins are non-transferable — you cannot send them to other users, sell them, or trade them outside 2chat. Any attempt to do so (including third-party trading sites) is a breach of these Terms and may lead to forfeiture of your balance.
- We reserve the right to adjust prices, item costs, or the earn-rate of free Coins. Material adjustments are announced in-app at least 14 days in advance and never apply retroactively to Coins already in your wallet.
- Cheating, exploiting bugs, automated farming, or otherwise accruing Coins by means other than the intended in-app mechanisms is strictly prohibited and we may revoke any Coins so obtained.
- On account deletion (or after a final, court-confirmed judgement against us where required by law) any unredeemed Coin balance is forfeited without compensation.
8b. Premium subscription
Premium is a recurring subscription billed by Stripe at the price displayed in the Shop. It auto-renews each period until cancelled. To cancel, email privacy@2chat.tv — cancellation takes effect at the end of the current paid period. Premium perks (badges, priority queue, etc.) are cosmetic / functional benefits within the service; they do not confer any right of redemption for cash. Refund rights are governed by our Refund Policy.
9. Suspension & termination
We may suspend or terminate your access to 2chat at any time without notice if we reasonably believe you have violated these Terms, our Community Guidelines, or applicable law. You may terminate your account at any time from the Settings tab. Upon termination, all your personal data is erased except where retention is required by law (see the Privacy Policy).
10. Disclaimers
2chat is provided “as is” and “as available”. To the fullest extent permitted by law, we do not warrant that the service will be uninterrupted, error-free or secure. We are not responsible for the conduct of other users or for any content they transmit. You are responsible for your own decisions to interact with strangers on the platform.
11. Liability
To the fullest extent permitted by applicable European Union law, our total liability under or in connection with these Terms in any rolling twelve-month period is limited to the greater of (a) the amount you paid us in that period and (b) EUR 50. Nothing in these Terms limits liability for fraud, gross negligence, wilful misconduct, or any liability that cannot lawfully be limited under EU law or under any mandatory consumer-protection law of your habitual residence.
12. Changes to these Terms
We may amend these Terms from time to time. When we publish a new version we will display a notice in the app on your next login and will not enforce material changes against you until you accept them. The current effective date and version are shown at the top of this page.
13. Governing law & jurisdiction
These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of the European Union, including (without limitation) the General Data Protection Regulation (Regulation (EU) 2016/679), the Digital Services Act (Regulation (EU) 2022/2065), the Consumer Rights Directive (Directive 2011/83/EU), and the e-Commerce Directive (Directive 2000/31/EC), as supplemented by the national implementing law of the EU Member State where the operator is established (see the Legal Notice). Nothing in these Terms affects any mandatory consumer-protection rights you enjoy under the law of your habitual residence.
Any dispute that cannot be resolved amicably will be brought before the competent courts of the EU Member State where the operator is established. Consumers in the European Union may also use the European Commission’s ODR platform at ec.europa.eu/consumers/odr.
